Leave Your Life in the Court’s Hands?

“I don’t get it. Why do we need Stand-Your-Ground in Idaho? Don’t we already have it?”

That was one of the most recent comments I read on our Facebook page about the Idaho Second Amendment Alliance’s effort to pass real Stand-Your-Ground in Idaho.

The real question is, “Do you want to leave your life in the hands of a judge or prosecutor?”

The time for Stand-Your-Ground is now, and you can help push it forward — more on that in a moment.

First, we must recognize that Idaho is one of the best states to live in as a gun owner.

Our carry laws are some of the strongest in the country.

The courts are generally favorable to our cause.

But that may not always be the case.

Slowly but surely Idaho is becoming infested with gun grabbers who wish to turn back time and revert to the days when criminals were the only ones with guns.

It may only be a matter of time before the liberal cities in Idaho grow large enough to turn us into the next Oregon or Washington.

If that day is to come, we need to make Idaho’s gun laws the strongest in the nation NOW, before it’s too late.

We don’t want to wait around until Bloomberg and his anti-gun cronies have swarmed Idaho like parasites to destroy our beautiful state.

And with that swarm of gun grabbers come activist judges and anti-gun prosecutors, hell bent on making an example out of a gun owner who defends his/her life in self-defense.

Picture this for a moment.

Your wife is home alone with the kids while you are out of town working.

She hears the front door open.

The kids are sound asleep for an afternoon nap.

She grabs the shotgun and heads straight for the door.

When she gets to the front door, there is a stranger standing in the doorway.

He stands there silently, staring at your wife.

She screams at him to leave or she will shoot.

The man, undeterred by her threat, stands still.

That’s when your wife decides to follow through on her promise to defend her home and the lives of the people inside.

She blows the intruder out of the doorway with one shot, killing him instantly.

Now her whole life and your entire family’s life is about to change forever.

The question for Idahoans is, “Should we leave her life in the hands of a judge or prosecutor?”

Idaho’s Stand-Your-Ground law currently says you have no “duty to retreat.”

However, a prosecutor is allowed to submit evidence that you could have run away, and charge you with murder.

Your wife, who only wanted to defend her life and the lives of your children, could be at the mercy of the court system if they feel she could have done something differently.

Never mind that some thug was inside your home uninvited.

Never mind that your wife just had to take the life of another human being.

Now they want to charge her for defending your home?

They want to charge her because she didn’t first try and run away.

Now, some will say that Idahoans have “no duty to retreat” from an old case law in the early 1900’s, but what they aren’t telling you is that in that same case they also ruled that a prosecutor can submit evidence that you could have run away!

And that’s what we want to change!

What would an Idaho Second Amendment Alliance Stand-Your-Ground bill look like? Under our bill Idahoans would have the following protections:

1) Face no so-called “duty to retreat.”

Under Idaho law, this isn’t a requirement.      However, a prosecutor is free to argue you could      have avoided a dicey situation by retreating, and      a jury could be persuaded to agree.

In a situation where your life is on the line, the      LAST thing you want to be thinking about is what      some anti-gun judge or prosecutor might say;

2) Receive criminal immunity from anti-gun      prosecutors.

In other words, no more anti-gun prosecutors      trying to make an example of you — or taking a      case to court to make a political statement;

3) Receive civil immunity.

That means the money-grubbing family of some thug      you had to defend yourself against, can’t come      after you in court and sue you for millions!

If those protections sound good to you, then we have some work to do to achieve our goal of getting a crucial roll call vote on the bill next session!

That’s why we need your help.

We can’t leave gun owner’s lives in the hands of a judge or prosecutor seeking to make a political statement.
