2018 Idaho Gubernatorial Survey

Question 1

“Constitutional Carry” was passed during the 2016 Idaho legislative session. However, some elements of a full Constitutional Carry bill were left out of the 2016 version. Despite the fact that current non-residents can carry their shotguns and rifles anywhere in the state concealed without a permit, and despite the fact that the same non-residents can carry their handguns outside of city limits concealed without a permit, they can’t carry their handguns inside city limits concealed without a permit. This makes our law confusing for residents, non-residents, and law enforcement.

Will you support or oppose Constitutional Carry legislation which will extend Constitutional Carry to include city limits for all adults over the age of 21, not prohibited by law, regardless of their status as an Idaho resident or not? 

Question 2

Current Idaho laws says that people that citizens must be 21-years-old to carry a firearm concealed without a permit. Will you support or oppose legislation that lowers the age limit to carry a firearm without a permit to 18-years-old, as long as they aren’t prohibited by law?

Question 3

Idaho’s current Stand-Your-Ground law has several major flaws that make self-defense risky. For instance, despite our laws saying you have no “duty to retreat,” a prosecutor and judge can introduce evidence that a “reasonable” person would have done something different than you, and they can convince a jury that you should have run away. This is known as the “duty to retreat loophole.” Additionally, Idaho’s Stand-Your-Ground law contains no solid Presumption of Innocence without qualifiers and contains no Criminal Immunity which is crucial to preventing anti-gun elected officials from prosecuting you for acting in self-defense.

Will you support or oppose legislation that would strengthen Idaho’s existing Stand-Your-Ground and Castle Doctrine laws to include closing the “duty to retreat loophole,” adding an unqualified Presumption of Innocence, and adding Criminal Immunity?

Question 4

Idaho’s “Campus Carry” law gives power to university boards to regulate the carrying of concealed firearms on public university campuses.

Will you support or oppose legislation to remove the power of public universities to regulate the carrying of concealed firearms on campus, and return the power to the legislature?

Question 5

Idaho’s Campus Carry statute is extremely restrictive and confusing. Students who live on campus aren’t even allowed to store their firearms where they reside. One way to simplify and expand our Campus Carry law is to expand Constitutional Carry to include all portions of a public campus, including housing.

Will you support or oppose legislation that would expand Constitutional Carry to include all portions of a public college/university, to include living spaces?     

Question 6

Idaho’s preemption statute currently prohibits Idaho government entities, such as cities and counties, from enacting rules and regulations which are stricter than state law in regard to firearms and ammunition. However, no penalties exist for governmental entities or individual government officials who violate this important law knowingly and willfully.

Will you support or oppose legislation which would lay out penalties for governmental entities and individuals who knowingly and willingly violate the preemption statute?

Question 7

Will you oppose legislation to implement “Universal Background Checks” which force law-abiding citizens to go through government mandated background checks when even selling firearms to their own family members, friends, or acquaintances?

Question 8

“Red Flag” laws are sweeping the nation. These laws allow firearms to be removed from citizens without due process. In fact, a conviction, trial, or the ability of the citizen to defend themselves before going to court does NOT exist under these laws. Will you oppose all forms of so called “Red Flag” laws which remove a citizen’s firearms from their possession with no due process?

Question 9

Will you oppose all methods of gun control, including those that the media calls “reasonable,” such as laws that disallow those with simple misdemeanor convictions from owning and carrying guns, increasing the minimum age of those who carry or purchase guns for lawful purposes, new taxes on ammunition, and new ways to track guns and gun owners?

Question 10

Will you oppose legislation banning the manufacture, sale or possession of semi-automatic firearms and/or standard-capacity magazines, recognizing that these restrictions do nothing to stop crime but only serve to harass gun owners?
