2020 Idaho Primary Survey

The Idaho Second Amendment Alliance conducts a survey for legislative candidates (Representative and Senator) each election cycle to determine where they stand on specific issues as it relates to the 2nd Amendment. Questions are generally derived from specific state legislation we are seeking to implement or oppose but some are broader in nature.

The ISAA Legislative Survey serves to inform the public about where candidates stand on these issues and we expect those seeking office to be willing to put their name on public record on where they stand on one of the most, if not the most, important issues to Idahoans.

Question 1

When radical progressives take over a state, they almost immediately launch attacks on gun rights. We are seeing this in the state of Virginia and are witnessing it in Oregon and Washington as well. One way that Idaho could protect our gun rights in the long term would be to amend Article 1 Section 11 of our state constitution to make it much stronger. In particular, ensuring that specific items such as magazine capacity, firearms accessories, and modern sporting rifles could not be banned via statute.

Would you be willing to support a constitutional amendment to Article 1 Section 11 that would further strengthen Idaho’s right to keep and bear arms by preventing gun control measures that would ban modern sporting rifles, firearms accessories, or magazine capacities? 

Question 2

Idaho’s current Stand-Your-Ground law does not contain the Criminal Immunity provisions that are crucial to preventing anti-gun prosecutors from prosecuting gun owners for acting in self-defense. Such provisions would help prevent innocent gun owners being railroaded through the criminal justice system and potentially bankrupted.

Will you support legislation to strengthen Idaho’s existing Stand-Your-Ground and Castle Doctrine laws by including Criminal Immunity?

Question 3

Idaho’s “Campus Carry” law is extremely restrictive, and broad powers are given to the university boards to regulate the storage and carry of concealed firearms on public university campuses.

Will you support legislation to remove the power of public universities to regulate firearms on campus, and return the power to the legislature?

Question 4

Idaho’s preemption statute currently prohibits local Idaho governments or political subdivisions of the state from enacting rules and regulations that restrict Second Amendment rights.  It prohibits them from regulating the possession, transfer, and all other aspects of firearms and ammunition. However, no penalties exist for governmental entities, or individual government officials who knowingly and willfully violate this important law.

Will you support a bill that lays out penalties for government officials, or those acting on their behalf who knowingly and willingly violate the preemption statute?

Question 5

Will you oppose all methods of gun control, including those that the media calls “reasonable,” such as laws disallowing those with simple misdemeanor convictions from owning and carrying guns, increasing the minimum age of those who carry guns for self-defense, imposing new taxes on ammunition, and implementing new ways to track guns and gun owners?

Question 6

Do you oppose legislation banning the manufacture, sale or possession of semi-automatic firearms, firearms accessories, or magazines of any capacity; recognizing that these restrictions do nothing to stop crime and only serve to harass gun owners?

Question 7

Will you oppose legislation to implement “Universal Background Checks” which force law-abiding citizens to go through government-mandated background checks even when selling or transferring firearms to their own family members, friends, or acquaintances?

Question 8

Would you support a legislative proposal that prohibited the implementation of gun control measures through the ballot initiative process?

Question 9

Do you oppose any and all forms of Extreme Risk Protection Orders, commonly called Red Flag laws?
