After Constitutional Carry was passed last year, the Idaho Second Amendment Alliance sought to strengthen Idaho’s Castle Doctrine law.
Castle Doctrine is the simple concept that says your home is your Castle, and you have a right to defend it.
What is the Castle Doctrine and how can you help move it forward? More on that below!
While Constitutional Carry was certainly the primary goal of the ISAA, our ultimate goal is the full restoration of the 2nd Amendment. That is going to take some time and there are going to be many battles along the way.
You are an integral part of helping us accomplish these goals!
With that in mind, why are we fighting for a better Castle Doctrine?
The reality is that Idaho’s laws currently protect the criminal in a home invasion case — not the home owners.
We will not sit idly by and let this continue!
Idaho’s current law says that if someone breaks into your home, they must be in the act of committing a felony for you to defend your life, or you must feel that your life is in jeopardy.
What happens if a creepy man just happens to be standing in your doorway, uninvited? A mom let’s say, at home during the day with the door open to let in the fresh spring air — she fires at the criminal because she is unsure if they are about to do her harm or not?
If she take his life in defense of her own home, she may be on the hook for murder!
Is that how the law should be? Absolutely not!
In addition, what if an anti-gun prosecutor decides to take you to court and you have to spend 10’s of thousands of dollars defending yourself?
You defended yourself once. You shouldn’t have to do it again in court.
That’s what the ISAA is seeking to change!
First, we want to change the presumption of innocence to the gun owner who has defended his/her life. If you fire in self-defense, you are presumed to have done so in fear of your life or the lives of your loved ones.
It is then up to the prosecutors and law enforcement to try and prove that you didn’t act in self-defense, but murdered the individual.
You are however, presumed innocent until proven guilty!
Second, if a prosecutor should take you to court for defending your life, and you are found innocent, you are reimbursed for legal expenses.
This important piece of the Castle Doctrine upgrade we are seeking will help prevent an anti-gun prosecutor from taking a gun owner to court who has clearly fired his gun in self-defense.
Third, we want to make sure that the Castle Doctrine extends to your vehicle and your place of business.
